The terms that apply to engagements with Orkateq Pty Ltd. Every build is delivered with source code, documentation and accounts in your name, and scope and outcome are agreed before work starts.

About these terms
These terms apply when you use this site or engage Orkateq Pty Ltd (Orkateq, we, us) to do work for you. They cover scope, ownership, fees, confidentiality, liability and governing law.
Using this site
This site is provided for general information only. Nothing on it is advice for your particular situation, and nothing on it forms an agreement by itself.
Scope of work
The scope and expected outcome of each engagement are agreed in writing before work starts.
Any work outside the agreed scope needs a separate agreement.
Ownership
Every build is delivered with its source code, documentation and accounts in your name.
Ownership of the intellectual property we create for you passes to you once you have paid for it in full. Until then, it remains ours. We may reuse our general methods, techniques and expertise in other work, but not your code, data or configuration.
Fees and payment
Fees are set out in the agreement for each engagement. Invoices are payable within 14 days of the invoice date. If an invoice is overdue, we may pause work until it is paid.
Confidentiality
Each party will keep the other party's confidential information confidential, use it only for the engagement, and not disclose it to anyone else without consent unless the law requires it. This continues after the engagement ends.
Liability
Our total liability to you for an engagement is limited to the fees you paid us for that engagement in the 12 months before the claim. We are not liable for indirect or consequential loss, including lost profits or lost data. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
Governing law
These terms are governed by the laws of Australia. You submit to the non exclusive jurisdiction of the courts of Australia.
Notices
Any notice under these terms must be sent in writing to info@orkateq.com.
Changes to these terms
We may update these terms from time to time. When we do, we will change the date on this page. Changes do not affect an engagement already under way.
